Privacy Policy of Shibaura Machine Co., Ltd.

Shibaura Machine CO., LTD. (“Shibaura Machine”) believes it is the company’s social responsibility to appropriately handle and protect information that can identify a specific individual, such as the name, address and e-mail address of its customers, shareholders, officers and employees (“Employees, etc.”) (collectively, “Data Subject”) or information containing an individual identification code (as defined in Paragraph 2, Article 2 of the Act on the Protection of Personal Information) (collectively, “Personal Information”), and implements the following policy.

Article 1 (Compliance with Applicable Laws and Regulations)

When handling Personal Information, Shibaura Machine complies with all relevant laws and regulations concerning the protection of Personal Information as well as internal rules of Shibaura Machine.

Article 2 (Purpose of Use)

Shibaura Machine specifies the purpose of use of the Personal Information; handles the Personal Information only to the extent necessary for achieving such purpose, and does not handle it beyond such extent. Additionally, if the laws and regulations that regulate Personal Information further limit the purpose of use of specific Personal Information, Shibaura Machine will not handle the Personal Information for any purposes other than such further limited purpose. Article 3 (Acquisition of Personal Information)

Shibaura Machine collects Personal Information only through appropriate and legitimate means and only to the extent necessary for conducting its business.

Article 4 (Appropriate Management of Personal Information)

Shibaura Machine implements measures to prevent unauthorized access to, loss, destruction, falsification and leaks, etc. of Personal Data (as defined in Paragraph 6, Article 2 of the Act on the Protection of Personal Information). Shibaura Machine endeavors to keep Personal Data accurate and up-to-date to the extent necessary for the purpose of use and to delete it without delay when it becomes no longer necessary for use.

Article 5 (Restriction on Provision to Third Parties)

Shibaura Machine, in principle, does not provide Personal Data to any third party, except in case where a Data Subject has given its consent or in accordance with laws and regulations. However, if handling of Personal Data is outsourced to others to the extent necessary for achieving the purpose of use; in the event of a corporate merger, etc. or if the use of Personal Data is shared between specific parties specified separately, the Personal Data may be provided to parties other than Shibaura Machine without the consent of the person concerned.

Article 6 (Handling of Sensitive Personal Information)

Shibaura Machine does not collect Sensitive Personal Information (means information concerning race, creed, social status, medical history, criminal record, fact of having been a victim of a crime, or other such information; the handling of which requires special care so as not to cause discrimination, prejudice or other disadvantages to the person concerned) of a Data Subject, except in cases where a Data Subject has given its prior consent or in accordance with laws and regulations.

Article 7 (Supervision of Contractors)

When Shibaura Machine outsources handling of the Personal Data of a Data Subject, to a third party, Shibaura Machine appropriately supervises such third party so as to ensure that the information is managed safely by such party by entering into relevant agreements and taking other measures.

Article 8 (Shared Use)

The Personal Data of the Data Subject except for shareholders, shall be shared within the Shibaura Machine group of companies. Please refer here for further details.

Article 9 (Request for Disclosure of Personal Information)

If a Data Subject contacts Shibaura Machine with a request for the disclosure, correction, addition, deletion, suspension of use and erase of the Personal Data retained by Shibaura Machine, Shibaura Machine shall handle such request promptly to a reasonable extent, unless otherwise provided for in laws and regulations.

Article 10 (Management System)

Shibaura Machine shall continuously provide the Employees, etc. with relevant training and education, for the purpose of enhancing efforts to protect the Personal Information on a company-wide level.

Article 1 Definition

The terms used in this Privacy Policy shall be defined as follows:

Applicable Privacy
Laws and Regulations
means applicable privacy laws and regulations, including the General Data Protection Regulation (“GDPR”) of EU and the relevant national implementation acts.
Agreement means an agreement or a contract between a customer and Shibaura Machine, concerning products or services etc.
Personal Data means any information relating to an identified or identifiable natural person that is Processed by Shibaura Machine, as specified in Article 3 of this Privacy Policy.
Privacy Policy means this privacy policy.
Process (Processed or Processing) means any single operation or a series of operations which is performed on Personal Data or on a set of Personal Data, whether or not by automated means (including collection, recording, editing, structuring, storage, adaptation and/or alternation, retrieval, reference, use, disclosure by transmission, dissemination or otherwise making available, alignment and/or combination, restriction, erasure and/or destruction of data).
Controller means the natural or legal person, governmental authority or body, or others which, alone or jointly with others, determine the purpose and means of Processing Personal Data.

Article 2 Scope of Privacy Policy

  1. This Privacy Policy applies to every use of the Website by a user of the Website (“User of Website”) and the Processing of Personal Data via the Website, to which the Applicable Privacy Laws and Regulations are applicable. Shibaura Machine is the designated Controller for this Processing.
  2. The Website may contain information of third parties (for example, hyperlinks or banners). Shibaura Machine does not control such third parties’ information and is not responsible for compliance with the Applicable Privacy Laws and Regulations on behalf of these third parties. We ask the User of Website to carefully read the privacy policies of the third party websites they are visiting.

Article 3 Personal Data to be Collected

  1. Shibaura Machine may collect the following Personal Data from the User of Website:
    name, company or organization, department, job title, contact information etc.
  2. Shibaura Machine does not collect any sensitive Persona Data, such as passport information and health data, through the Website, except as set forth in the Applicable Privacy Laws and Regulations.
  3. Shibaura Machine collects the Personal Data when a User of Website:
    • Registers on the Website;
    • Makes an application for employment through the Website; or
    • Otherwise uses the Website.
  4. Shibaura Machine only Processes the Persona Data in accordance with the Applicable Privacy Laws and Regulations, as specified in this Privacy Policy.

Article 4 Purposes and Legal Ground of Data Processing

  1. Shibaura Machine collects and Processes the Personal Data only for the purposes listed below:
    • Performance of an Agreement, or for responding to the request from a User of Website prior to entering into an Agreement: if a User of Website places an order through the Website, Shibaura Machine may Process the Personal Data of such user in order to perform an Agreement. Shibaura Machine does not Process the Personal Data beyond the extent that is necessary for the performance of an Agreement.
    • Communication: Shibaura Machine may use the Personal Data of the User of Website in order to: (i) communicate about Shibaura Machine's products and services, (ii) provide information that is important to the User of Website regarding their use of the Website, and (iii) to handle any complaints. Such Processing of the Personal Data is necessary for performing an Agreement and/or in order for Shibaura Machine to obtain the legitimate interests in the course of conducting its normal business.
    • Marketing: In order to contact a User of Website via e-mail for marketing purposes, Shibaura Machine shall request such user’s prior consent at all times, unless it concerns products that are similar to products such user has previously ordered. A User of Website has the right to unsubscribe from the mailing list of Shibaura Machine at any time. Such Processing of the Personal Data is necessary in order for Shibaura Machine to obtain the legitimate interests in the course of contacting a User of Website to offer similar products or services. Otherwise, this Processing shall be made based on the prior consent from a User of Website.
    • Customer Service: When a User of Website uses customer service, Shibaura Machine may use the Personal Data of such user to provide customer services. Such Processing of the Personal Data is necessary for performing an Agreement and/or in order for Shibaura Machine to obtain the legitimate interests in the course of conducting its normal business.
    • Application for Employment: When a User of Website applies for employment through the Website, Shibaura Machine may use the Personal Data of such user to handle such application. This Processing of the Personal Data is necessary in order for Shibaura Machine to obtain the legitimate interests in the course of recruiting individuals to work for Shibaura Machine group.
  2. If Shibaura Machine intends to further Process the Personal Data for purposes other than the Processing purpose at the time of collection of the Personal Data, it shall provide information about such other purposes and all relevant additional information before such further Processing.

Article 5 Transmission of Personal Data to Third Parties

Shibaura Machine shares the Personal Data of the User of Website within the Shibaura Machine group.

Article 6 Security

Shibaura Machine implements appropriate organizational and/or technical security measures to protect the Personal Data of User of Website and to prevent misuse, loss or alteration thereof. Furthermore, Shibaura Machine limits access to the Personal Data to its employees, agents, contractors and other third parties who need access to such Personal Data. Those aforementioned persons are bound by an obligation to maintain confidentiality, either in accordance with their employment agreements or (data processing) agreements.

Article 7 Retention Periods

  1. Shibaura Machine does not store the Personal Data of the User of Website beyond the extent that is necessary for the purpose for which such Personal Data is collected.
  2. User of Website may request Shibaura Machine to delete their Personal Data at any time. Furthermore, when the Personal Data is no longer necessary or required for the purposes of collecting or Processing, Shibaura Machine deletes such Personal Data.

Article 8 Cookies

  1. Shibaura Machine uses cookies to ensure that the Website functions properly.
  2. Cookies are information stored by the browser on the computers of User of Website. Shibaura Machine uses different types of cookies for different purposes.
    • Functional cookies: cookies necessary for the Website to function properly, including cookies necessary for creating an account;
    • Analytical cookies: cookies used to obtain information on how the Website (or a part of the Website) is used by a User of Website. With such information, Shibaura Machine can improve the Website so that the Website can fit as much as possible with what the User of Website finds interesting and important. Shibaura Machine only uses the data obtained with these cookies to analyze how the Website is being used.
  3. Shibaura Machine only uses third parties’ cookies for the purpose of improving the quality and effectiveness of the Website.

Article 9 Rights of User of Website

  1. As long as the Processing of the Personal Data is based on consent, the User of Website has the right to withdraw consent in respect of their Personal Data at any time.
  2. The User of Website has the right to request access to their Personal Data. This allows the User of Website to receive a copy of their Personal Data retained by Shibaura Machine.
  3. The User of Website has the right to request correction of their Personal Data retained by Shibaura Machine. This allows the User of Website to have any incomplete or inaccurate data concerning themselves, which are retained by Shibaura Machine, corrected.
  4. The User of Website has the right to request deletion of their Personal Data. This allows Shibaura Machine to delete the Personal Data that Shibaura Machine has been Processing without legitimate reasons.
  5. The User of Website has the right to raise objections to the Processing of their Personal Data which Shibaura Machine conducts for its legitimate interests. If Shibaura Machine has been Processing the Personal Data for the purposes of direct marketing, Shibaura Machine shall accept the objections from User of Website at all times. If Shibaura Machine has been Processing the Personal Data for other purposes, Shibaura Machine shall cease the Processing of the Personal Data, unless it has compelling legitimate reasons (i) which override the interests or rights and freedom of the User of Website, or (ii) which are related to the commencement or implementation of legal action or for the proof of claims purposes.
  6. The User of Website has the right to request restriction on the Processing of their Personal Data.
  7. The User of Website has the right to request a transmission of their Personal Data to themselves or to a third party. Shibaura Machine shall provide a User of Website or a third party designated by such user with the Personal Data of the said user in a structured, commonly used, machine-readable format. Please be advised that this right only applies to automatically Processed information for which User of Website initially provided consent or which Shibaura Machine used to perform an Agreement with a User of Website.
  8. The exercise of the aforementioned rights is free of charge. Shibaura Machine will provide information about the follow-up to the request from User of Website immediately and in any case within one (1) month of receipt of such request. This period may be extended by another two (2) months, depending on the complexity of the request and the number of requests. Shibaura Machine will notify a User of Website of such an extension within one (1) month of receipt of the request.
  9. If a request from a User of Website is clearly ungrounded or excessive, in particular if the same request is made repeatedly, Shibaura Machine will either charge such User of Website a reasonable fee or refuse to respond to the request from such user.
  10. In addition to the aforementioned rights, a User of Website has the right to file a complaint to a supervisory authority (in particular, a supervisory authority in the EU Member State where the User of Website habitually resides, or at the place of work or where an alleged infringement of the GDPR occurred) at any time. However, Shibaura Machine would appreciate an opportunity to deal with concerns of User of Website, before they contact the supervisory authority. Your initial contact to resolve the issue would be highly appreciated.

Article 11 Miscellaneous

  1. Shibaura Machine reserves the right to revise this Privacy Policy on a regular basis. It is the responsibility of User of Website to regularly review the applicable provisions. This Privacy Policy was last revised in September 2018.
  2. If a provision of this Privacy Policy is in conflict with the laws or regulations, it shall be replaced by a provision of the same purport that reflect the original intention of the provision, to the extent legally permissible. In this case, the remaining provisions shall remain applicable and unchanged.
